The City of Flagstaff is seeking a dedicated and detail-oriented Risk and Compliance Manager to lead our risk management efforts and ensure compliance with policies, regulations, and best practices. About the Role: As the Risk and Compliance Manager for the City of Flagstaff, you will play a pivotal role in protecting the City of Flagstaffs assets, employees, and reputation. Under general direction of the Human Resources and Risk Management Director, employees of this class are expected to perform highly responsible management, administrative, and supervisory duties associated with the day-to-day operations of the Citys risk management, compliance, and safety programs (including loss prevention, training, workers comp, and safety activities; risk transfer through insurance procurement and contract review; risk and compliance consultation to all levels of City management and staff; internal claim adjusting; financial management of liability; and workers compensation claims).Serves as the Citys Americans with Disabilities ADA Coordinator. ADMINISTRATIVE DUTIES Supervisory: This job has full responsibility for supervision (hires, directs, schedules, transfers, promotes, rewards, and disciplines.) Budgetary: This job has full responsibility for budgeting at the section level (prepares, implements, and manages) including the section budget and Self Insured Trust Fund. Strategic Planning: This job has full responsibility for strategic planning at the section level (develops, implements, interprets, and manages long and short-term goals). Policies/Procedures: This job has full responsibility for policies and procedures at the section level (develops, implements, and interprets). Compliance: This job has full responsibility at the section level for (follows, ensures compliance with, enforces, and interprets) Federal, State, and Local laws, rules, and regulations as well as City policies and procedures. This includes but is not limited to Code, Charter and Directives of the City of Flagstaff. Council Communications: This job has full responsibility at the section level for Council communication (makes recommendations and presentations, writes staff summaries, ensures Performance Measures are met, and balances needs with Councils adopted priorities and direction). Reporting: This job has full responsibility for reporting to Federal/State/Local agencies at the section level (ensures reporting requirements are met, trains others on reporting requirements and methods, and addresses discrepancies in reporting through section and self auditing). EXAMPLES OF THE WORK PERFORMED (ILLUSTRATIVE ONLY) Provides excellent customer service to both internal and external customers. Manages the planning, development, implementation, administration, and coordination of the Citys Risk Management and Compliance programs; monitors and interprets changes in laws and regulations and makes recommendations to ensure City programs remain compliant. Plans, prioritizes, assigns, supervises, and reviews the work of any assigned staff; provides direction regarding work assignments and projects; and evaluates performance. Fosters the development of a culture of Risk Management and Compliance where employees are empowered to make decisions at every level. Evaluates, builds, and integrates programs to build employee morale. Analyzes claims and trends in order to assess needs for OSHA mandated training, develop programs, and deliver to employees. Mentors and coaches on safety related topics including the development of Job Hazard Analysis and Standard Operating Procedures. Negotiates and may make settlements with claimants or advise legal counsel and Human Resources & Risk Management Director on claims including determining litigation strategies, valuing claims, setting reserves for expected expenditures, selecting legal counsel, attending dispositions, arbitrations, mediations, and trials. Works with the City Attorneys office as the Citys liaison with outside counsel. Consults with employees and management on a variety of issues including review of contracts to determine if contract language insulates the City from adverse claims, establishes required levels of insurance, and protection from vendors and contractors. Performs site inspections for OSHA compliance and hazard assessment. Oversees DOT MVR compliance program and oversees quarterly random drug and alcohol testing. Oversees fingerprint audit compliance. Reviews indemnification language. Reviews exposures and confirms insurance placement for special events to ensure that the financial exposure to the City from loss is minimized. Manages vendor relations and performance to ensure compliance with Risk Management and City of Flagstaff expectations and favorable terms. Coordinates and manages loss recovery through subrogation and restitution efforts. Develops policies in order to gain compliance with legal mandates, enhance loss control efforts, and gain clarity and uniformity of processes and procedures. Prepares correspondence to employees, applicants and other outside agencies related to Human Resources issues. Establishes and maintains committees, informal groups, and communication strategies to meet the strategic goals of the Human Resources & Risk Management section and the City. Performs work of substantial difficulty in the operations of a comprehensive risk management and compliance program including determining proper levels of insurance coverage, external liability, handling claims, and monitoring the industrial injury managed care program to include workers comp and determining ADA accommodations and authorization to return to work. ensuring compliance with legal requirements. Serves as the Citys ADA Coordinator responsible for compliance to section 504 - Title I, II, III & IV regulations. Receives and manages inquiries and grievances from the public concerning disability rights and receives and processes accommodation requests. Other functions of this role include filing necessary reports and providing consultative services to City departments and agencies. Confers with staff and citizens to address a variety of compliance, liability, safety, training, insurance, risk and injury issues while identifying the law, regulation or policy required to meet the standard and mediates situations to prevent escalation of issue into unnecessary claim or suit against the City. Investigates and resolves citizen complaints that cannot be handled by other Human Resources & Risk Management staff. Bids, procures and manages the Citys insurance program including reviewing property, equipment and facilities as well as costs, coverage and self-insured retentions. Determines whether asset is self-insured or obtains insurance coverage. Reviews contracts and determines if contract language meets the Citys needs and avoids acceptance of risk when not warranted, offers modified language and reviews final documents to assure conformance. Organizes and implements loss control, loss prevention programs, and risk retention programs to prevent serious impact on the Citys financial structure. Determines acceptability of contracts for risk management and insurance provisions. Reviews current court cases to ensure compliance with Code, City policies, Charter, Directives and practices, making changes when necessary. Prepares bid specifications for insurance coverage to be used in the bidding process, reviews bid proposals, recommends contracts to be awarded, and presents recommendations to the City council. Administers accident review board hearings and regulations. Coordinates Risk Management activities with other City divisions to ensure loss control and loss reduction measures are implemented and effective. Collaborates with the Human Resources and Risk Management Director to negotiates and settles non-litigated, self-insured claims; processes final payments. Researches and recommends options and associated costs for the Citys workers compensation program. Upon the direction and recommendation of the Human Resources and Risk Management Director, maintains close working relationship with the City Attorneys office on legal issues, contracts, and judicial pronouncements affecting risk management activities. Works with City Attorneys office on EEO, Labor Relations, City Policy and Directives interpretation issues, concerns, and investigations. Obtains and prepares data to perform analysis of exposure information, identify pure risk occurrence, and determines the financial consequences of such losses. Monitors and directs the Citys workers compensation and ADA Accommodation programs in collaboration with the Human Resource Division. Participates in professional group meetings at the recommendation and direction of the Human Resources and Risk Management Director and stays abreast of new trends and innovations in the compliance, risk management, and insurance fields. Maintains federal, state, and local poster compliance program. Completes reporting for, oversees and ensures compliance with EEO-4 and OSHA 300-A. Works closely with AMRRP insurance pool and claims adjusters and specialist concerning claims; manages and monitors subrogation and restitution, through tracking, mediation and collections. Manage software and tracking of liability and work comp claims, random drug screenings, CDL compliance, annual physicals for CDL, respirator and asbestos, ensuring notification and scheduling is assisted, and completion documented. Complete review of special event and contract insurance coverage. Performs related duties, as assigned. MINIMUM REQUIREMENTS Bachelor's Degree in Business Administration or a related field. Five years of responsible managerial and administrative experience in risk management. Three years of supervisory experience. Certified as an Associate in Risk Management or must obtain within one (1) year of employment. Or any combination of education, experience, and training equivalent to the above Minimum Requirements. Must complete Security Awareness and National Crime Information Center (NCIC)/Criminal Justice Information System (CJIS) certification within six months of hire/transfer and be recertified every two years. Must maintain certifications in NCIC/CJIS as a condition of continued employment. Obtain relevant OSHA certification and training for the position. DESIRED EXPERIENCE AND TRAINING Certified Risk Manager (CRM), Counselor of Insurance, and/or Chartered Property Casualty Underwriter (CPCU) certification preferred; experience in claims management, public risk management experience preferred. Three years of experience with OSHA compliance. Three years of experience in claims handling. Three years of experience in Workers Compensation. Three years of experience in contract indemnity language and insurance requirements/review. Licensed Arizona Risk Management Consultant. OTHER REQUIREMENTS Must possess, or obtain upon employment, a valid Arizona drivers license. Regular attendance is an essential function of this job to ensure continuity. Weekend, evening, and holiday work may be required. REQUIRED KNOWLEDGE, SKILLS AND ABILITIES (ILLUSTRATIVE ONLY) Considerable knowledge of the principles and practices of the insurance industry including property, casualty, public liability, workers compensation lines of coverage, risk financing techniques, insurance policy procurement and negotiating skills. Considerable knowledge of Arizona laws relating to public liability management. Considerable knowledge administering OSHA, ADOSH, DOT, ADA and other local, state, and federal regulations. Ability to effectively investigate, evaluate, negotiate, and settle claims. Skill in the analysis development and implementation of effective, efficient, and economical risk management and safety programs and procedures. Ability to develop and implement cost effectiveness and operating procedures. Ability to communicate effectively both verbally and in writing, including reports and correspondence composition, with all levels of staff and the public. Ability to establish and maintain effective working relationships with City staff and officials, legal staff, insurance agencies, state agencies, vendors and the general public. Ability to objectively and analytically problem solve often within short time frames. Strong financial analysis and number skills. Strong interpersonal skill in mediating conflict. Knowledge of City locations, operations, facilities, and equipment. Knowledge of new developments in the field/profession. Skill in budget preparation and monitoring; ability to analyze equipment, material, and manpower costs. Ability to develop, implement, and interpret clear strategic plans, policies, and procedures. Ability to effectively supervise and manage staff. Ability to research, prepare, and present comprehensive written and oral reports to Human Resources and Risk Management Director, City Management, Mayor and Council, and others as required. Ability to effectively analyze and effectively report upon operating conditions and problems, and to recommend or implement appropriate solutions. Ability to represent risk management and compliance concerns and matters to Council Members, the City Manager, City legal team, the media, and governmental regulatory agencies. Ability to exercise considerable judgment and discretion and make difficult and independent decisions without supervision. Ability to conduct oneself in a professional manner. Ability to effectively resolve managerial, administrative, and supervisory problems.
