The minimum qualifications required for this vacancy.Minimum Qualifications J.D. with at least 10 years of experience as an attorney admitted to practice in the State of New YorkSupervisory experienceUnderstand the role of the prosecutor and their ethical responsibilitiesSubstantial litigation experienceExcellent legal research and writing skillsExperience supervising complex investigationsJudgment necessary to navigate complex questions of ethics and legal practiceAbility to exercise discretion and confidentiality with sensitive mattersPreferred Qualifications Experience as a criminal defense attorney or prosecutorExcellent oral advocacy skillsProven track record of collaborating/being a team playerExperience creating policies and procedures for investigationsThe duties that the incumbent of the vacancy will be expected to perform.Duties Description Under the supervision of the Administrator, the Deputy Director of Investigation will oversee investigations conducted by the Commission on Prosecutorial Conduct's (CPC) out of its New York City office. Duties of the Deputy Director of Investigation will include, but will not be limited to:Supervising the attorneys, investigators, and administrative staff investigating confidential and sensitive investigations regarding allegations of prosecutorial misconduct in New York State;Engaging in preliminary fact-finding and analysis of complaints submitted to the CPC and drafting memoranda for the Commission to aid in its determination of whether to open an investigation;Investigating complaints authorized by the Commission;Drafting reports summarizing the findings of investigations and providing recommendations to the Commission on whether to authorize formal complaints;Reviewing all memoranda, pleadings, and filings associated with complaints;Assisting the Administrator in preparing for hearings;Assisting the Administrator in presenting evidence at hearings;Assisting the Administrator with developing administrative policies, programs, and procedures to implement the CPC's policies;Working with executive staff in preparing for commission meetings;Conducting, in conjunction with other staff, comprehensive training sessions for both new and existing staff on pertinent legal matters and investigative techniques;Other special projects as needed to enable the CPC to carry out its statutory mandate.Additional Comments The Commission on Prosecutorial Conduct is an independent State agency dedicated to investigating prosecutorial conduct in New York State, serving to strengthen oversight of New York's prosecutors and to hold them to the highest ethical standards in the exercise of their duties. Pursuant to Judiciary Law §§ 499-a – 499-j, the Commission has the authority to review and investigate the conduct of prosecutors to determine whether any prosecutorial conduct violates state law or court rules. Under the statute, the Commission is authorized to conduct a full range of investigative functions, including holding hearings, subpoenaing witnesses, requiring production of documents, conferring immunity, and transmitting findings of fact and recommendations regarding sanctions to the relevant attorney grievance committee.
