Description Reporting directly to the Director of Human Resources and Payroll, with a dotted-line relationship to the Director of Access, Compliance and Title IX, the Employee Relations Investigator/Compliance Specialist will perform investigations, must possess a strong understanding of, and dedicated adherence to, confidentiality, neutrality, provides administrative, compliance and program support for the Director of Human Resources and Payroll, the Office of Human Resources and Payroll, as well as the Director of Access, Compliance, and Title IX and the Office of Access, Compliance, and Title IX staff. Performs a variety of strategic programmatic, investigative, administrative and staff support duties for the Human Resources and Payroll office, Office of Access, Compliance, and Title IX, which require a range of skills and a knowledge of organizational policies and procedures along with the ability to work independently. Resolves administrative problems and inquiries; composes, edits, and proofreads correspondence and reports, and prepares a range of administrative document Investigations - Human Resources and Payroll (45%) • Conduct prompt, fair, impartial and thorough investigations into employee relations issues concerning allegations such as discrimination, harassment, bullying, retaliations, hostile work environment, workplace violence, and UT policy violations, etc. • Assess whether a matter requires investigating or pursuing other courses of action such as mediation, conflict resolution, team building, etc. • Conducts investigatory interviews; collect and analyze relevant evidence, write investigative reports outlining findings and submit to appropriate individuals. • Ensure consistent application of UT university policies, procedures, and external compliance. • Formally respond to sensitive concerns and allegations as required by the internal processes and/or external agencies in a timely manner. • Utilize case management software in Oracle for archiving employee relations reports, data, and for performing analytics to inform decision making and change management strategies. • Participate in the development and deployment of employee relations-related training; foster effective relations with the human resources team, employees, legal counsel and leaders across the university. Investigations - Access, Compliance and Title IX (45%) • Under administrative direction investigates complaints (ie, formal; informal) such as harassment, Title VI, Title VII, Title IX and EEO, which will include interviewing witnesses, assisting with notetaking, analyzing evidence, making determinations, advising alternative resolutions and collaborating with appropriate administrators/departments. In conjunction with applicable administrator/department formulates appropriate course of action to take. Determines appropriate information necessary to respond to external complaints. Writes case analysis of complaints. • Conducts intake interviews; determines the jurisdiction and timeliness of complaints; participates in interviews to establish the basis of an allegation; and obtains documents and information relating to complaints. • Assists investigation team by performing a variety of technical and administrative duties to support the operations of OACT. • Assists in preparation of investigation reports that involves summarizing information and stating pertinent facts, and supporting the Director of Access, Compliance, and Title IX when conducting formal investigations. • The incumbent will transfer complaints that are clearly not appropriate for OACT action based on criteria and standards established in UT policy the OACT Director and Vice Chancellor. • May resolve complaints (i.e., informal; formal) in collaboration with the Director and under direct supervision requiring minimal intervention. Training and Presentations (5%) • Ensures that the University community is sufficiently aware and knowledgeable of who the Title IX Coordinator is and how to contact the coordinator. • Title IX: coordinates Title IX/VAWA Programming (SAAM; DVAM); Title IX/VAWA Training (Mandatory Reporting; Complaint Procedures); Title IX/VAWA Messaging (Flyer; Email; handout); Designs, develops, and delivers training programs and workshops to UTM professionals involved in the search/hiring process for faculty and executive positions addressing EEO/AA efforts. • Delivers a range of educational and informational presentations, and/or resource materials related to compliance related activities and initiatives. • Conducts individual, group, and organization-based training covering Title IX/sexual harassment, Mandatory Reporting, and other compliance-based activities. • Collects program data and participant feedback using surveys, assessments and evaluations. Administrative Support (5%) • Assists in the overall implementation of compliance reporting (i.e., Title IX; Title VI; EEO/AA; VETS 100) in OACT including coordination of educational programming, communications, and supporting administration of the complaint procedures for faculty, staff, students and other members of the UT Martin community. • Assist Human Resources and Payroll in implementing new and innovative processes campus wide. • Maintains a high level of confidentiality and may liaise with the Office of General Counsel to provide documentation or verbal information on complex matters. • Perform other duties as assigned by the Director of Human Resources and Payroll. Qualifications: Qualification Minimum Qualification • Bachelor's degree in a relevant field and three years of relevant experience, or an equivalent combination of education, training, and experience. • Possess a strong interpersonal, oral and written communication skill, complemented by high emotional intelligence. • Database management skills, and skill in the use of personal computers and related software applications. • Knowledge of compliance and human resources concepts, practices, policies, and procedures. • Skill in organizing resources and establishing priorities. • Ability to show initiative and to demonstrate a high degree of confidentiality and discretion and problem-solving strongly preferred. • Ability to make administrative/procedural decisions and judgments. • Ability to create, compose, and edit written materials. • Knowledge of computerized information systems used in financial and/or accounting applications. • Ability to be flexible, work independently and have high accountability for a large volume of work. • Ability to communicate effectively and interact well with people of all ages and diverse backgrounds. • Ability to demonstrate respect and empathy when confronted with difficult and uncomfortable situations surrounding investigations. Preferred Qualification • Knowledge of the principles and practices of office management and general administration. • Exhibit and support a positive attitude and encourage a positive attitude in co-workers. • Trained investigator or completed investigator training.
