NATURE OF WORK: This position is responsible for administering the TERO program and carrying out the day to day operations of the Nisqually Employment Rights Commission.DUTIES AND RESPONSIBILITIES:
- Ensure that all covered employers give preference to Native Americans in hiring, promotion, training, layoffs and all other aspects of employment as required by Title 42, Tribal Employment Rights Ordinance.
- Contact all employers on the reservation and inform them of the requirements of Title 42.
- Ensure that covered employers comply with the rules, regulations, guidelines, and orders of the Nisqually Tribal Employment Rights Commission.
- Ensure Native preference in contracting and subcontracting as required.
- Administer the system for certifying businesses entitled to Native American preference.
- Ensure each covered employer or entity submits an acceptable compliance plan to the Commission indicating how it will comply with Title 42.
- Establish numerical hiring goals and timetables specifying the minimum number of Nisqually tribal members, tribal member spouses and/or other Native Americans each employer must hire by craft or skill level.
- Ensure covered employers establish or participate in training programs deemed necessary by the Commission in order to increase the pool of qualified Native Americans on Tribal lands as quickly as possible.
- Work with other tribal employment and training programs to establish a Tribal hiring hall or skills bank.
- Ensure employers do not use qualification criteria or other requirements that serve as barriers to native preference in employment.
- Work cooperatively with unions to ensure union compliance.
- Investigate all complaints; attempt to achieve informal settlement if violations are found or notify individuals making complaints of the process to request hearings before the Commission if the complaint does not warrant action or is found not to have merit.
- Notify employers and the Nisqually Employment Rights Commission of violations of Title 42 and issue notices of non-compliance and assess penalties consistent with this Title when informal resolutions cannot be reached.
- Gather information and keep records on the number of Nisqually tribal members, tribal member spouses and other Native Americans who are available to fill job openings, their skills and qualifications, and whether they are interested in receiving training.
- Review reports submitted by employers in accordance with this Title and conduct investigations to determine whether employers are meeting the requirements of this Title.
- Take other actions necessary to achieve the purposes and objectives of the Nisqually Employment Rights Program established in Title 42.
- Perform other duties as assigned.
KNOWLEDGE, SKILLS, AND ABILITIES:
- Knowledge of Tribal and Indian preference laws, employment law, and fair employment practices.
- Knowledge of Federal and State contract and grant management activities as they pertain to TERO and Indian Preference and EEOC issues.
- Knowledge of Nisqually Title 42 and the operational objectives of the TERO program.
- Knowledge of Nisqually Tribal history, culture, traditions, and values.
- Knowledge and general understanding of common construction practices.
- Knowledge of workplace training programs.
- Knowledge of bona fide qualification criteria and barriers to native preference in employment.
- Skill in the operation of the personal computer, common computer software such as MS Office suite, and common office equipment.
- Ability to investigate thoroughly, define problems, collect data, establish facts and draw conclusions.
- Ability to analyze and interpret an extensive variety of information, communicate findings and recommend problem solving strategies.
- Ability to initiate and follow through on complex administrative tasks, meet deadlines, and respond effectively in all situations including those that are stressful or have unforeseeable complications.

MINIMUM QUALIFICATONS:
- Bachelor's Degree in Business Administration, Human Resources, Education, Organizational Development, Construction Management or a related area.
- Must have at least 3 years' experience working in a TERO program, tribal human resources, or construction management for a tribal entity.
- Must have a valid driver's license and be insurable under the Tribe's insurance policy.
